Charles V formally created the Royal and Supreme Council of the Indies to advise the Crown and administer Spain’s overseas dominions, centralizing governance for the Americas (and later other imperial territories).
In the initial organization of the new council, García de Loaysa y Mendoza was appointed its first president, marking the start of regularized high-level oversight of colonial administration from Spain.
The Council’s operating rules were set out in formal ordinances (ordenanzas), reflecting the need to regulate its expanding legislative, fiscal, and judicial workload and to standardize decision-making procedures for colonial governance.
The Crown issued the New Laws to limit abuses of Indigenous peoples and restrict the perpetuation of the encomienda system—an inflection point in imperial governance that the Council would help implement and interpret.
Under Philip II, the Council developed as an autonomous body with legislative, executive, and judicial functions and was established in Madrid, aligning imperial administration with the monarchy’s fixed court.
A specialized Cámara de Indias (chamber) was created within the Council to handle key matters—especially appointments and patronage—mirroring similar institutional arrangements in peninsular governance.
Philip III abolished the Cámara de Indias to streamline decision-making and improve processing of business, reflecting recurring tensions between specialization and bureaucratic complexity in imperial administration.
A major codification of colonial law, the Recopilación de Leyes de los Reynos de las Indias, was approved under Charles II, consolidating thousands of provisions and providing a standardized legal framework used across the empire.
In early Bourbon reforms, Philip V created a Secretariat of the Navy and the Indies, increasingly transferring executive administrative functions away from the Council and toward ministerial structures better suited to centralized reform.
The Crown moved the Casa de Contratación (the empire’s trade and navigation administration) from Seville to Cádiz, reshaping the flow of colonial paperwork and coordination between trade administration and the Council’s governance roles.
Charles III created the Archivo General de Indias in Seville to centralize documentation of overseas administration, drawing heavily on records produced by the Council of the Indies and related imperial institutions.
During the liberal constitutional moment of the Cortes of Cádiz, the Council of the Indies was abolished, reflecting efforts to dismantle old-regime conciliar governance in favor of constitutional-administrative reforms.
After Ferdinand VII returned and reversed many Cádiz-era reforms, the Council of the Indies was restored, with renewed staffing and advisory activity despite the accelerating crisis of imperial authority in the Americas.
A Royal Decree suppressed the Councils of Castile and the Indies (among others), reorganizing governance and judicial administration and marking the definitive end of the Council of the Indies as an imperial governing institution.
