Queensland’s Aboriginal Protection and Restriction of the Sale of Opium Act 1897 entrenched a protectionist regime that allowed officials to remove Aboriginal people to reserves and separate children from families by administrative decision (without a court hearing), foreshadowing later large-scale child removals.
Western Australia’s Aborigines Act 1905 created the Chief Protector of Aborigines as legal guardian of Aboriginal children (to age 16) and empowered authorities to send and detain children in institutions and in ‘service’ (work), underpinning later forced removals.
New South Wales’ Aborigines Protection Act 1909 established a regulatory framework for Aboriginal lives and reserves that was later strengthened to allow broader child removals—an important legal foundation for the Stolen Generations in NSW.
The Northern Territory Aboriginals Act 1910 (South Australia) established a Chief Protector and made the office legal guardian of Aboriginal and ‘half-caste’ children (up to 18), enabling institutional confinement and removals that became central to later Stolen Generations experiences in the Territory.
After the Commonwealth took control of the Northern Territory, the Northern Territory Aboriginals Ordinance 1911 further empowered the Chief Protector to assume “care, custody or control” of Aboriginal and ‘half-caste’ people—including children—on discretionary grounds, entrenching administrative removals.
The Aborigines Protection Amending Act 1915 (NSW) removed the requirement that Aboriginal children be found “neglected” before the Board could remove them, greatly widening state power to take children and accelerating forced removals in NSW.
NSW’s Aborigines Protection Board was replaced by the Aborigines Welfare Board under 1940 amendments, framed as “welfare” modernisation but continuing intrusive control and assimilation-oriented practices affecting Aboriginal families and children.
In response to the harms of child removals, Aboriginal community-controlled advocacy developed the Aboriginal Child Placement Principle in the early 1980s; from 1983 it began to be incorporated into child welfare/adoption laws, prioritising placements that maintain Aboriginal children’s family, community, and cultural connections.
On referral by the Commonwealth Attorney-General, the Human Rights and Equal Opportunity Commission established the National Inquiry into the Separation of Aboriginal and Torres Strait Islander Children from Their Families (1995–1997), setting a national process to document forced removals and their impacts.
The Inquiry’s terms of reference were expanded (including advice on compensation principles) and the reporting date was extended to 31 March 1997, reflecting the scope and complexity of evidence gathering.
The Inquiry’s final report, Bringing Them Home, was tabled in the Australian Parliament on 26 May 1997, presenting extensive testimony and 54 recommendations aimed at healing, records access, and policy change regarding the Stolen Generations.
National Sorry Day was first held on 26 May 1998—one year after Bringing Them Home was tabled—creating an annual nationwide commemoration acknowledging the Stolen Generations and supporting healing and reconciliation.
The Australian Parliament passed the Motion of Reconciliation on 26 August 1999, recognising historic mistreatment of Indigenous Australians and expressing regret, though it stopped short of a formal apology for forced child removals.
Prime Minister Kevin Rudd delivered the National Apology in the Australian Parliament on 13 February 2008, formally apologising for the laws and policies that resulted in the forcible removal of Aboriginal and Torres Strait Islander children and acknowledging the profound harms caused.
