Parliament amended the Indian Act to criminalize participation in the “Indian festival known as the potlatch” (and related ceremonies). This marked the formal beginning of federal legal suppression of Northwest Coast ceremonial governance and wealth redistribution practices.
The anti-potlatch provision—widely treated as the potlatch ban—is commonly dated as taking effect on January 1, 1885, and would remain embedded in Canadian law until 1951. Enforcement varied over time, but the ban created ongoing legal risk for ceremonial hosting and participation.
Early enforcement was inconsistent; the statute’s vagueness about what acts constituted a “potlatch” created practical difficulties for conviction and encouraged officials to focus on discouragement and surveillance rather than reliable prosecutions in some periods.
An 1895 Indian Act amendment further expanded criminalization of Indigenous ceremonies, including festivals and dances involving the giving away of money or goods, reinforcing legal pressure on potlatch-like practices and related ceremonial economies.
The Royal Commission on Indian Affairs for the Province of British Columbia (McKenna–McBride Commission) began hearings across the province on reserves and land questions. Although distinct from the potlatch law, its work formed part of the broader coercive administrative environment affecting community governance during the ban era.
A 1914 Indian Act amendment restricted wearing “Aboriginal costume” (regalia) at dances, exhibitions, stampedes, and similar public events without official approval, further limiting visible cultural expression alongside the potlatch prohibition.
First Nations leaders in British Columbia formed (and strengthened) the Allied Tribes of British Columbia to press the “Indian land question” and advocate for Aboriginal title and rights—organizing during a period when cultural and political repression, including the potlatch ban, remained in force.
In December 1921, ‘Namgis Chief Dan Cranmer hosted a major potlatch at Village Island (Mimkwamlis/Memkumlis) attended by hundreds. The event became the focal point for the most consequential crackdown of the potlatch-ban era in British Columbia.
Following investigation by Indian Agent William Halliday and police, participants in the 1921 potlatch were arrested and prosecuted under the Indian Act’s potlatch provisions. This crackdown signaled intensified enforcement and produced long-term impacts through imprisonment, intimidation, and compelled pledges to stop potlatching.
Court outcomes from the 1921 crackdown included prison sentences (notably at Oakalla Prison, Burnaby), with many Kwakwaka’wakw leaders and participants convicted for actions framed as “dancing,” “speechmaking,” and gift distribution—core elements of potlatch governance and law.
As a result of prosecutions and pressure following the 1921–1922 cases, ceremonial items and regalia were surrendered or confiscated and later dispersed into museum and private collections. This displacement of cultural property became a central legacy of the potlatch ban in British Columbia.
A 1927 amendment to the Indian Act prohibited soliciting funds for Indigenous legal claims without government permission, effectively shutting down many organized efforts to pursue Aboriginal title in court and contributing to the dissolution of the Allied Tribes of British Columbia.
A major 1951 revision of the Indian Act removed the potlatch prohibition (commonly described as deleting Section 149), ending the criminal ban that had targeted potlatch and related ceremonial life for decades.
After legalization in 1951, Kwakwaka’wakw and other Northwest Coast communities intensified efforts to recover confiscated ceremonial property and rebuild public cultural institutions, including initiatives that ultimately supported the creation and growth of community-based cultural centres and repatriation programs.
