Toyotomi Hideyoshi’s 1591 “Separation Edict” helped formalize restrictions on status mobility (warriors vs. peasants/townspeople and their dependents). Tokugawa governance built on and hardened these late-16th-century separation policies that underpinned later controls over servile labor and dependent households.
During the early Edo period, authorities formalized a status hierarchy (often summarized as shi-nō-kō-shō) while also classifying “outsiders,” notably eta and hinin, associating them with stigmatized occupations and segregated communities. This status system shaped coercive labor expectations and social exclusion in urban and rural settings.
Tokugawa Ieyasu’s victory at Sekigahara (1600) was followed by his appointment as shōgun, inaugurating the Tokugawa polity (Edo period). This new regime would regulate labor, household service, and outcaste status through domain and shogunal law, shaping coercive domestic service and marginalization of eta/hinin.
After the Ōsaka campaigns, Tokugawa authorities issued a decree in October 1616 targeting human trafficking and abusive bondage arrangements. Research on Tokugawa legislation notes the decree capped nenki hōkō (term service) to a short term and treated attempts to sell people into perpetual bondage as a severe crime, reflecting an early shogunal effort to suppress trafficking networks rather than end dependency itself.
A set of thirteen articles published in late 1619 further systematized Tokugawa policy against kidnapping and trafficking. These provisions punished intermediaries, addressed parents selling children, and ordered the return or liberation of kidnapped persons—illustrating how the bakufu distinguished between suppressing illicit trafficking and tolerating regulated forms of dependent service.
Tokugawa authorities later imposed limits on the duration of servitude contracts; one widely cited measure capped terms at 10 years (often dated to 1625). Such caps aimed to curb de facto perpetual bondage and trafficking-like practices while leaving a broad space for regulated indenture and household service.
Tokugawa Iemitsu inaugurated sankin kōtai (alternate attendance) in 1635, requiring daimyō to maintain residences and large retinues in Edo. The system expanded the scale of elite consumption and household organization, indirectly increasing demand for servants and dependent labor in castle towns and along travel routes.
By the late 17th century, restrictions on servitude length were relaxed (commonly dated to 1698), allowing extended-term service (einenki bōkō) and hereditary/lifelong forms (fudai bōkō) in some contexts. This reflected the adaptability of Tokugawa labor arrangements: formal opposition to trafficking coexisted with practices that could still bind people long-term.
By the early 1700s, authorities imposed visible status markers and restrictions on eta/hinin (e.g., clothing and hairstyle rules, curfews, and enforced deference), reinforcing segregation and making status legible in daily life. These measures institutionalized stigma and constrained mobility and occupational choice.
Facing fiscal strain and political pressure, the Tokugawa government virtually abolished sankin kōtai in 1862. The change reflected weakening central control and altered the economic and household-service demands tied to daimyō residences in Edo.
The collapse of the Tokugawa shogunate (1867–1868) brought major legal and social restructuring. Reforms soon targeted hereditary status categories, including outcaste designations, reshaping how coercive labor and social exclusion were regulated in the new state.
The Meiji government issued proclamations abolishing the appellations eta and hinin and ordering their treatment as commoners in registers (often referred to collectively as the Emancipation Edict/Kaihōrei). While legal status was formally equalized, social discrimination persisted and, in some areas, triggered violent backlash.
