Japan surrendered at the end of World War II, and the Allied Occupation began soon after. Occupation authorities made democratization and the protection of basic human rights major goals, creating political space for gender reforms. Women’s organizations and reform-minded officials then pushed to turn these goals into law and practice.
In late 1945, election law changes gave Japanese women the right to vote and run for office. This broke with prewar rules that excluded women from national politics. The reform set up women’s first large-scale entry into electoral democracy.
On April 10, 1946, women voted in a national election for the first time. Thirty-nine women won seats in the House of Representatives, a visible step toward political inclusion. Their presence helped put everyday issues like family life, work, and welfare more firmly on the postwar agenda.
The new Constitution was promulgated in 1946, establishing a rights-based framework that later reforms could rely on. It included equality under the law and, crucially for women’s rights, a clear statement that marriage must be based on mutual consent and the equal rights of husband and wife. This created constitutional pressure to rewrite family and labor laws that treated women as dependents.
A revised Imperial Household Law was passed in early 1947 as Japan rebuilt its legal system under the new constitutional order. It modernized rules around the imperial household but kept the throne limited to male heirs. This showed that postwar reforms expanded women’s rights in many areas while leaving some high-status institutions unchanged.
In March 1947, a Child Welfare Bureau was created within the welfare administration to strengthen policy for children and maternal health in the difficult postwar years. Officials faced urgent problems such as children left without adequate care and weak public health systems. Building this administrative capacity helped shift women’s issues from “private family matters” toward public policy responsibilities.
Japan enacted the Labor Standards Act in 1947 to set minimum working conditions nationwide. The law included a “principle of equal wages for men and women” and introduced protections connected to pregnancy and childbirth. While not ending workplace inequality, it established a legal baseline and a language of equal treatment that later advocates could cite.
In April 1947, Japan held its first election for the House of Councillors (the new upper house). Women could vote and compete for seats in this new chamber as well, expanding women’s role beyond a single election cycle. The new two-house Diet became the main arena where rights reforms were debated and turned into law.
The Constitution came into force in May 1947, making its rights guarantees legally active. Article 24, focused on the family, explicitly tied marriage and family law to “individual dignity” and the “essential equality of the sexes.” With the Constitution now binding, lawmakers moved to revise the Civil Code and other statutes to match these principles.
In 1947–1948, reformers helped establish a Women’s and Minors’ Bureau within the new Ministry of Labor, creating a permanent government unit focused on women workers and children. Leaders emphasized issues like maternity leave, childcare, and equal pay, even as enforcement remained limited. This institutional step mattered because it made women’s labor conditions a continuing state responsibility, not a temporary postwar campaign.
Japan passed the Child Welfare Act in December 1947, giving a stronger legal framework for child protection and related services. The law supported expanded government responsibility for children’s care and welfare, which also affected women as primary caregivers and as workers in welfare institutions. This was part of a broader shift toward a postwar social welfare state.
Civil Code changes in line with Article 24 took effect in 1948, reshaping marriage, divorce, inheritance, and household authority. The reforms weakened the old “ie” (patriarchal household) model and moved legal status toward the individual rather than the family head. This was a major turning point because it changed women’s rights inside the family, not just in politics.
In July 1948, Japan promulgated the Eugenic Protection Law. It aimed to “protect the life and health of the mother” while also promoting eugenic goals, and it created a legal basis for sterilization and certain abortions under specified conditions. In practice, the law became linked to serious human-rights harms, especially for people with disabilities, showing that “reform” could expand some choices while also restricting bodily autonomy for others.
In September 1948, activist and Diet member Oku Mumeo helped found Shufuren (the League of Housewives). The group organized around consumer protection and household economics, such as price controls and product quality, and argued that home life should matter in national politics. This broadened women’s civic activism beyond elections into sustained policy pressure.
By 1950, local women’s groups had reorganized in many places, including federations like the Tobata Women’s Association in northern Kyushu. These groups worked on practical community problems—food, health, and later pollution—using meetings, surveys, and campaigns. Their growth showed how women’s postwar rights were increasingly exercised through local civic action, not only through national laws.
In 1950, Japan enacted a new Nationality Law. It provided that a child is a Japanese national if, at birth, either the father or the mother is Japanese, a significant rule for women’s equal legal status in family life and citizenship transmission. The law also helped standardize nationality rules in the postwar legal order.
In 1952, Chifuren (National League of Regional Women’s Organizations) was formed to connect and coordinate local women’s associations across Japan. It worked on social policy issues and defended key postwar legal reforms, including the Constitution and Civil Code changes affecting women’s status in the family. This helped sustain women’s political influence during a period when formal political representation remained limited.
In 1960, Nakayama Masa was appointed minister of health and welfare, becoming the first woman to serve in Japan’s cabinet. The appointment did not mean equal representation had been achieved, but it marked a breakthrough into top-level national leadership. It also reflected the slow shift from immediate postwar legal reforms toward longer-term political inclusion.
