After large numbers of Loyalist settlers arrived following the American Revolution, Britain reorganized the Province of Quebec’s government. The Constitutional Act created two new colonies—Lower Canada and Upper Canada—with British-style institutions such as an elected assembly and appointed councils. It was passed on 1791-06-10 and scheduled to take effect later that year.
Under the Constitutional Act, large portions of land were reserved to support a “Protestant clergy.” These reserves became politically controversial, especially in Upper Canada, because many people believed they unfairly favored the Church of England and slowed practical development like roads and compact settlement. Disputes over the reserves fed broader arguments about equality, religion, and who benefited from colonial policy.
The Constitutional Act took effect, officially dividing the former Province of Quebec into Upper Canada (broadly the future Ontario) and Lower Canada (broadly the future Quebec). Each colony had a lieutenant governor and an elected legislative assembly, but real power still sat largely with appointed executive and legislative councils. This structure set up long-running disputes over who controlled money, patronage, and policy.
Upper Canada’s elected Legislative Assembly met for the first time at Newark (now Niagara-on-the-Lake). The meeting marked the start of representative politics under the new colonial constitution, even though the appointed councils and the lieutenant governor could still block much legislation. The early assemblies became training grounds for political factions and reform movements.
Upper Canada passed a law to prevent further importation of enslaved people and to set rules leading to gradual emancipation for children born to enslaved mothers. It did not immediately free people already enslaved, but it marked a significant policy change for the colony. The act is often noted as an early anti-slavery step within the British Empire’s territories.
The capital of Upper Canada was moved from Newark to York (now Toronto), strengthening the colony’s administrative center and shaping later settlement and political networks. Concentrating government offices in York also helped a small group of officials and allied elites build influence. Over time, this contributed to complaints about patronage and “closed” decision-making.
By the early 1800s, informal elite networks gained strong influence over appointments, courts, and policy—especially the Family Compact in Upper Canada and the Château Clique in Lower Canada. Reformers argued that the elected assemblies had too little real power compared with the governor and appointed councils. This imbalance became a core grievance behind later reform campaigns and, eventually, rebellion.
Lower Canada’s elected assembly adopted the Ninety-Two Resolutions, a detailed list of grievances and reform demands led by Louis-Joseph Papineau and the Parti patriote. Key issues included control over public spending and calls for greater accountability of the executive to the elected assembly (often described as “responsible government”). Britain’s refusal to grant these demands helped push politics toward confrontation.
Britain responded to the Ninety-Two Resolutions with the Russell Resolutions, rejecting major reforms sought by the elected assembly. The decision signaled that London would not accept the assembly’s push to control budgets and make the executive accountable to elected representatives. The rejection intensified protests and contributed directly to the breakdown into violence.
Armed uprisings erupted in Lower Canada (beginning in November 1837) and in Upper Canada (December 1837), driven by frustration with oligarchic rule and limits on elected power. The rebellions were defeated, but they forced Britain to re-examine how the colonies were governed. The political crisis became the turning point that set the stage for major constitutional change.
Britain sent Lord Durham to investigate the causes of unrest, and his report was laid before Parliament in early 1839. The Durham Report recommended uniting Upper and Lower Canada and promoted the principle of “responsible government,” meaning the executive should depend on the confidence of the elected assembly. Britain moved quickly on union, while responsible government would come later.
The British Parliament passed the Act of Union to reunite Upper and Lower Canada under one legislature, creating the Province of Canada. The union was intended to stabilize government after the rebellions and to change how political power worked across the two regions. It also restructured representation and finances in ways that reshaped political conflict for decades.
The Act of Union came into force, abolishing the separate legislatures of Upper and Lower Canada and inaugurating the Province of Canada. This marked the endpoint of the 1791 constitutional framework and the start of a new political era focused on managing conflict within a single colony-wide parliament.
