Delegates met in Philadelphia to replace the Articles of Confederation with a stronger federal system. From the start, slavery affected key questions: representation in Congress, federal power over commerce, and what rights slaveholders could enforce across state lines. These conflicts drove a series of compromises that were written into the new Constitution.
Congress under the Articles of Confederation adopted the Northwest Ordinance to organize U.S. governance north and west of the Ohio River. It barred slavery in the territory while also including a provision for returning people “lawfully claimed” for labor who fled there, foreshadowing later national disputes over fugitives. This set an early federal precedent: Congress could shape slavery policy in U.S. territories even before the Constitution.
The Constitution’s representation formula counted “free Persons” fully and counted “all other Persons” at three-fifths for House seats and direct taxes. This increased political power for slaveholding states in Congress and the Electoral College, even though enslaved people had no political rights. It became one of the Constitution’s major slavery-related compromises.
The Constitution barred Congress from prohibiting the “Migration or Importation” of persons a state chose to admit until 1808, while allowing a limited import tax. This clause protected the international slave trade for two decades and was part of a broader bargain tied to federal control over commerce. It defined the earliest possible date for a national importation ban.
The Constitution required that persons “held to Service or Labour” who escaped into another state be delivered up to the party claiming them. This created a constitutional basis for slaveholders to pursue fugitives across state lines, even into states with different slavery policies. Later conflicts focused on how (and by whom) this clause would be enforced.
After nine states ratified, the new federal government began operating under the Constitution. The slavery-related compromises now had legal force: representation rules, limits on banning slave imports before 1808, and the requirement to return fugitives. The new government faced immediate questions about turning constitutional language into federal law.
The Constitution’s amendment article (Article V) included a temporary protection: until 1808, amendments could not affect the clause limiting Congress’s power over the “importation” of persons. This made the 1808 date harder to change and reinforced the earlier Convention compromise. It shows how slavery-related bargaining shaped not only policy but also the Constitution’s change rules.
Congress organized the Territory South of the River Ohio (often called the Southwest Territory) under a federal ordinance. Unlike the Northwest Ordinance, it did not prohibit slavery, helping slavery spread into parts of the new Southwest as settlement expanded. The contrast between the Northwest and Southwest ordinances showed that federal territorial policy could either restrict or permit slavery depending on political agreements.
Congress passed a law to implement the Constitution’s fugitive clause by creating a process for slaveholders or their agents to seize alleged fugitives and obtain legal certificates for removal. The act strengthened slaveholders’ ability to recover escapees across state lines and increased the federal role in enforcing slavery-related claims. It also raised due process concerns because accused fugitives had limited legal protections.
In his annual message to Congress, President Thomas Jefferson called for ending the international slave trade as soon as the Constitution allowed. This encouraged lawmakers to prepare legislation timed to the 1808 deadline. It also reflected a shift toward federal action against importation, even as slavery itself remained legal in many states.
Congress enacted a law prohibiting the importation of enslaved people into U.S. jurisdiction “from and after” January 1, 1808. President Jefferson signed it on March 2, 1807, setting the nation’s first nationwide ban on the international slave trade. The law targeted overseas importation, not slavery within the United States.
On this date, the constitutional waiting period ended and the 1807 importation ban became enforceable nationwide. The United States officially closed legal participation in the transatlantic slave trade, though illegal smuggling continued. The result was a major policy turning point: federal law now opposed new overseas imports even as slavery expanded through domestic trade and forced labor inside the country.
