Because the margin in Florida was extremely small, state law required a statewide machine recount (a second run through vote-counting machines). After the machine recount, Bush’s lead in Florida tightened further (reported widely as a few hundred votes). With the margin still razor-thin, the campaigns focused on ballot review rules and the deadlines for submitting county results. The stage was set for disputes over manual recounts and certification.
In Palm Beach County Canvassing Board v. Harris, the Florida Supreme Court extended the deadline for counties to submit amended results. The ruling aimed to allow more time for recount-related work while keeping the state on track for later election steps. It also intensified arguments that courts were changing election rules after voting had ended.
Florida’s Elections Canvassing Commission certified the statewide result and declared George W. Bush the winner of Florida’s electoral votes. The certified margin was 537 votes, but litigation continued as Gore pursued election “contest” claims (a legal challenge after certification). The certification mattered because it set an official baseline while courts considered whether additional ballots should be counted.
In Bush v. Palm Beach County Canvassing Board, the U.S. Supreme Court did not decide the election but sent the case back to the Florida Supreme Court for clarification. The Justices questioned whether the Florida court’s reasoning relied on federal constitutional grounds. This move signaled that the U.S. Supreme Court was prepared to play a direct role in the dispute.
Republican leaders of the Florida Legislature announced a special session to consider selecting a slate of presidential electors. They framed it as a safeguard in case court fights prevented final results by key federal deadlines. The announcement raised fears of competing slates of electors and an even deeper constitutional conflict.
The Florida Supreme Court ordered an immediate manual recount of “undervotes” (ballots where machines recorded no vote for president) statewide. The court also directed that certain additional votes be included in the count. This decision dramatically expanded recount activity and prompted an urgent appeal to the U.S. Supreme Court.
The U.S. Supreme Court ordered the recount to stop while it reviewed the case. Halting the manual counting froze an evolving vote total and made time itself a central factor, because election deadlines were approaching quickly. The stay set up an expedited, high-stakes decision on whether recount standards were constitutional.
The Court heard oral arguments on whether Florida’s recount process used unequal standards across counties and whether there was time to fix the problem. The dispute centered on the Equal Protection Clause (the constitutional rule that states must treat voters fairly and consistently). The arguments made clear the Court was deciding both recount rules and, indirectly, the election’s outcome.
In a 5–4 per curiam decision, the U.S. Supreme Court held that Florida’s recount lacked uniform standards and therefore violated equal protection. The Court also ruled that a constitutionally valid recount could not be completed in time under the case’s circumstances, effectively ending further counting. With recounts stopped, Florida’s certified result remained in place.
Al Gore publicly conceded and stated he would not pursue further legal challenges. The concession marked the practical end of the election dispute and allowed the transition to proceed without continuing uncertainty. It also cemented Bush v. Gore as the decisive turning point in the 2000 election.
A joint session of Congress met to count the Electoral College votes. Several House members attempted to object to Florida’s electoral votes, but under the Electoral Count Act an objection required support from both a House member and a Senator, and no Senator joined. With objections ruled out of order, Congress completed the count and finalized the Electoral College result.
George W. Bush took the oath of office, formally beginning the new administration. The inauguration closed the institutional process that began with the disputed Florida count. The episode left a lasting legacy in election administration debates and in how courts handle election disputes.
