After the Creek War, U.S. officials imposed the Treaty of Fort Jackson on the Creek Nation. The treaty required the cession of about 23 million acres in what is now Alabama and Georgia. This land loss helped set the stage for later U.S. pressure on southeastern Native nations to leave their homelands.
Congress passed the Indian Removal Act, and President Andrew Jackson signed it into law. The act authorized the President to negotiate land exchanges that moved Native nations west of the Mississippi River. In practice, it became a key legal tool used to pressure and remove many southeastern Native communities.
The Choctaw and the United States signed the Treaty of Dancing Rabbit Creek, one of the first major removal treaties carried out under the 1830 law. The agreement required the Choctaw to cede large areas in Mississippi in exchange for land in what became Indian Territory. It became a model for later removal agreements with other nations.
The Creek Nation and the United States signed a treaty in Washington, D.C., requiring the Creek to cede all remaining lands east of the Mississippi River. The treaty promised land in the West and protections, but settlers moved onto Creek lands quickly, fueling conflict and instability. This agreement accelerated Creek removal to Indian Territory in the following years.
Congress passed an updated Indian Intercourse Act that defined a broad region west of the Mississippi as “Indian Country.” This law helped formalize federal control over trade and non-Native entry into Native lands, and it provided a legal framework for an area increasingly described as Indian Territory. Over time, those boundaries were repeatedly narrowed as the United States expanded settlement.
A minority group of Cherokee representatives signed the Treaty of New Echota, agreeing to cede Cherokee lands in the Southeast for compensation and land in Indian Territory. Many Cherokee leaders and citizens opposed the treaty, but the United States treated it as binding. It later provided the legal basis for the forced Cherokee removal.
U.S. forces began rounding up Cherokee people and moving them west under military orders. The forced marches and detention camps contributed to widespread sickness, exposure, and death. The removal became a central event within the broader history often remembered as the Trail of Tears.
Congress ended the practice of making new treaties with Native nations by declaring that no tribe would be recognized as an independent nation “with whom the United States may contract by treaty.” Existing ratified treaties were not canceled, but the change shifted federal policy toward governing Native affairs primarily through statutes. This reduced Native leverage in negotiations over land and governance.
Congress passed the Dawes Act (General Allotment Act), promoting the division of tribally held land into individual allotments. The policy aimed to replace communal landholding with private-style ownership and to encourage assimilation, while allowing “surplus” lands to be opened to non-Native settlement. Over time, allotment contributed to major losses of Native land bases across the United States.
Congress created Oklahoma Territory and reorganized the legal system affecting Indian Territory. This separated the region into a western territory with a territorial government and an eastern Indian Territory where allotment and federal courts increasingly reshaped governance. The act marked a step toward combining the territories under a single state government.
Congress authorized the Dawes Commission to negotiate with and then enroll members of the Cherokee, Chickasaw, Choctaw, Creek (Muscogee), and Seminole nations for land allotment. Enrollment rolls became a powerful tool because they shaped who the U.S. government recognized as eligible for land and citizenship within these nations. The commission’s work helped set up the legal and administrative steps toward breaking up tribal landholding in Indian Territory.
Congress passed the Curtis Act, extending allotment policy to the Five Tribes and limiting the force of tribal law in Indian Territory. The act helped transfer authority from tribal institutions to U.S. federal structures, including U.S. courts. It was a major turning point that accelerated land allotment and reduced tribal governmental power in the years before statehood.
Congress passed the Oklahoma Enabling Act, which allowed residents of Oklahoma Territory and Indian Territory to draft a constitution and form a state government. The act rejected proposals for separate statehood for Indian Territory and instead set a path toward a single state. This decision tied the future of Indian Territory directly to Oklahoma statehood.
Oklahoma entered the Union after the two territories were combined under a new constitution. Statehood ended Indian Territory as a separate U.S. territory and further shifted legal and political control toward state and federal institutions. The result capped a long period in which removal, treaties, and allotment policies transformed Native landholding and governance in the region.
