British imperial forces crossed the Mangatāwhiri Stream into Waikato, which the Kīngitanga (Māori King movement) treated as a declared boundary (aukati). The invasion widened fighting in the New Zealand Wars and set the conditions for later land confiscations tied to “rebellion” and settlement policy.
Parliament passed the New Zealand Settlements Act, allowing Māori land to be confiscated from groups the Crown said were in “rebellion,” and then used for Pākehā settlement. Passed alongside the Suppression of Rebellion Act, it linked military conflict to a legal pathway for taking and redistributing land.
Governor George Grey issued a proclamation stating the Crown would retain land in Waikato taken by British forces within specified boundaries. This was a key step toward turning battlefield occupation into permanent Crown control, even before later orders formally used the Settlements Act machinery.
The Native Land Court was established, creating a new process for converting customary Māori land rights into Crown-recognized titles. This mattered because it weakened communal ownership structures and made later purchasing, leasing, and further dispossession easier within the colonial economy.
The New Zealand Settlements Amendment and Continuance Act strengthened and prolonged the confiscation framework, including expanding Compensation Court processes. It also set a limit: after 3 December 1867, the government’s power to proclaim new districts and reserve land for settlement would cease.
An Order in Council declared the East Wairoa and West Pukekohe blocks to be districts under the New Zealand Settlements Act and reserved land for settlement. This formalized confiscation administration: setting up “districts” and then designating “eligible sites” to be taken for colonial settlement.
A proclamation brought “Middle Taranaki” under confiscation policy, covering land between the Waitara River and the Waimate Stream, and enabled further sites to be taken for military settlement. This extended raupatu (confiscation) beyond Waikato and made settlement planning a central war objective.
Orders in Council declared the Central Waikato District to be under the Act and reserved parts of it for settlement and colonization, alongside other nearby blocks (including Māngere, Pukaki, Ihumātao, and Kerikeri). These steps moved confiscation from a legal claim into an active settlement program.
A proclamation declared much of southern Taranaki an “eligible site” for European settlement under the confiscation framework. The Crown later acknowledged that this policy caused major loss of life, property, and land, and it helped drive long-term displacement and hardship.
The New Zealand Settlements Act 1866 amended the earlier continuation law and confirmed certain actions taken under the 1863–1865 confiscation legislation. This reflected how confiscation policy required repeated legal “repair” to validate processes, titles, and administrative steps used to take and allocate land.
The Confiscated Lands Act 1867 was part of the legal work needed to manage land taken (or treated as taken) during the war years, including clarifying how confiscated land would be handled in law. By this stage, confiscation and settlement were being embedded into the colony’s long-term land system, not treated as temporary wartime measures.
Under the 1865 continuation legislation, the government’s authority to proclaim new confiscation districts and reserve land for settlement ended on this date. Although land issues continued long after, this closure marked the end of the main 1863–1870 legislative push that tied “rebellion,” confiscation, and planned colonial settlement into a single policy system.
