The Allahabad High Court ruled that Prime Minister Indira Gandhi had committed electoral malpractices in her 1971 Lok Sabha campaign. The court set aside her election and disqualified her from holding elected office, sharply escalating a political crisis and opposition demands for her resignation.
On Indira Gandhi’s advice, President Fakhruddin Ali Ahmed proclaimed a national Emergency, citing “internal disturbance” under Article 352. The proclamation enabled rule through extraordinary powers and set the stage for suspending civil liberties and curbing political opposition.
Within hours, police detained major opposition figures and activists, using preventive-detention powers to keep people jailed without trial. This crackdown weakened organized resistance and signaled that the Emergency would be enforced through arrests, surveillance, and restrictions on public assembly.
The government introduced strict press controls, including pre-censorship and other restrictions that limited reporting on arrests, protests, and government actions. These measures reduced public access to independent information and made it harder to challenge Emergency policies through open debate.
Indira Gandhi broadcast a “Twenty-Point Programme” focused on economic and social measures such as price controls and land reforms. Supporters presented it as a plan for discipline and development, while critics argued it was used to justify tighter political control during the Emergency.
Parliament passed the 38th Constitutional Amendment, which aimed to make Emergency proclamations and certain related decisions harder to challenge in court. The amendment was part of a broader legal strategy to reduce checks on executive power during the Emergency period.
The 39th Constitutional Amendment added provisions that sought to remove disputes over elections of top national leaders from ordinary judicial review. It was widely seen as a direct response to the legal threat created by the Allahabad High Court judgment against Gandhi.
The Supreme Court decided Indira Gandhi v. Raj Narain, overturning the lower-court conviction while also striking down parts of the constitutional changes that attempted to fully insulate the prime minister’s election from review. The judgment reinforced the idea that some constitutional limits—often discussed as the “basic structure”—cannot be removed by amendment.
In ADM Jabalpur v. Shivkant Shukla, the Supreme Court held (by a 4–1 majority) that courts could not hear many petitions challenging detention during the Emergency when enforcement of certain fundamental rights was suspended. The decision became one of the most criticized rulings in Indian legal history because it narrowed judicial protection for personal liberty at a time of mass detentions.
Parliament passed the 42nd Constitutional Amendment, a sweeping package that altered many parts of the Constitution during the Emergency. It is often described as a major attempt to strengthen the central executive and reduce legal constraints on government power, reshaping the constitutional balance for years afterward.
Indira Gandhi announced that parliamentary elections would be held in March 1977 and that Emergency restrictions were being eased, including releases of some prominent detainees. This decision shifted the Emergency from open-ended rule toward an electoral test of the government’s actions since June 1975.
India held Lok Sabha elections over several days in March 1977, with the Emergency still formally in effect. The campaign centered on civil liberties, detentions, and censorship, turning the vote into a national judgment on Emergency rule.
The Emergency proclamation ended, formally restoring normal constitutional conditions after 21 months of extraordinary rule. Although political and legal consequences continued, this revocation marked the clear endpoint of the Emergency as a nationwide suspension-era for civil liberties.
Election results brought a decisive defeat for the Congress government, and the Janata coalition formed India’s first non-Congress national government. Morarji Desai was sworn in as prime minister, and the new government moved to investigate Emergency abuses and reverse key legal changes made during the crackdown.
The post-Emergency government established the Shah Commission to examine how the Emergency was proclaimed and enforced, including censorship, detentions, and other state actions. Its interim and final reports documented patterns of misuse of power and helped shape later political debates about safeguards against future emergencies.
