British India was partitioned, and Pakistan was created as a new state with Muslim-majority areas in the west and east. From the start, leaders disagreed over how strongly Islam should shape the new country’s laws and institutions. These debates became central because Pakistan had no permanent constitution yet and was still building its state framework.
Pakistan’s Constituent Assembly adopted the Objectives Resolution, laying down guiding principles for the future constitution. It declared that sovereignty belongs to God and that authority is exercised as a trust through the people, while also promising democracy, fundamental rights, and minority protections. Religious parties and scholars treated it as a major step toward an “Islamic” constitutional order, while several non-Muslim members opposed it.
On the same day the Objectives Resolution passed, the Assembly created the Basic Principles Committee (BPC) to turn these principles into a workable constitutional design. The BPC’s work became a key arena where religious ideas (like Islamic limits on lawmaking) were argued alongside questions of elections, federalism, and civil rights. This process linked religious demands directly to early state-building and legislation planning.
The BPC delivered its first major report, proposing a constitutional structure that drew criticism—especially in East Pakistan—over representation and language, and also sparked debate about religious oversight in the state. The public and political reaction showed that “Islamic principles” alone would not settle constitutional arguments; they intersected with regional and democratic questions. The controversy forced the government to reconsider and revise its approach.
Religious scholars from several sects met in Karachi and issued “22 Points,” a shared minimum program for what they considered an Islamic constitutional system. This was politically important because it reduced sectarian differences into a common platform that parties and movements could use to pressure the state. It strengthened the role of religious actors in constitutional bargaining during the early 1950s.
A coalition of religious groups and parties launched mass agitation demanding actions against the Ahmadiyya community and the removal of an Ahmadi foreign minister. Violence and unrest in Punjab led to martial law in Lahore, showing how religious mobilization could directly challenge public order and civilian authority. The crisis also contributed to major political fallout at the federal level.
The government established a Court of Inquiry to investigate the Punjab disturbances tied to the anti-Ahmadi agitation. The inquiry gathered extensive testimony about how religious demands, party politics, and administrative decisions interacted. Creating this commission was an early attempt to use state institutions—courts and formal investigations—to respond to religiously driven political crises.
The inquiry’s report was issued, widely known as the Munir (or Munir–Kiyani) Report. It highlighted the risks of political actors using religious claims to mobilize the public and examined disagreements among religious leaders about defining who is a Muslim. The report became an influential reference in later debates on whether and how the state should enforce religious definitions through law.
After sustained protests in East Pakistan, the Constituent Assembly resolved to give Bengali official status alongside Urdu. While not a religious issue by itself, the decision shaped constitution-making by showing that legitimacy depended on accommodating major identity demands—language, representation, and rights—alongside Islam-based constitutional claims. It also set terms that would later be written into the 1956 Constitution.
Governor-General Malik Ghulam Muhammad dissolved the first Constituent Assembly, cutting short the original constitution-making body. This disrupted legislative development and shifted power toward the executive, affecting how religious and political forces could influence lawmaking. The dissolution led to legal battles that shaped Pakistan’s constitutional trajectory.
A new Constituent Assembly was elected indirectly through provincial assemblies to complete the unfinished constitution project. This new body inherited earlier religious-constitutional debates, including how to reflect the Objectives Resolution in enforceable law. It also faced intense political pressure to deliver a constitution quickly to stabilize the state.
West Pakistan’s provinces were merged into a single administrative unit (“One Unit”), aiming to create parity with East Pakistan. This major structural change affected constitution-making by changing how representation and federal power-sharing would work in practice. The scheme also influenced how religious parties and other groups organized their demands at the center versus the provinces.
The Constituent Assembly passed Pakistan’s first constitution, and it came into effect on March 23, 1956. The constitution declared Pakistan an “Islamic Republic,” incorporated Islam-linked principles associated with the Objectives Resolution, and recognized Urdu and Bengali as state languages. This marked a clear end point for the 1947–1956 constitution-making phase by turning contested religious and political ideas into a formal legal framework.
