The Central Bank of The Bahamas was established on June 1, 1974, taking on monetary policy and expanded financial-sector supervision. A stronger supervisory institution supported the growing offshore banking sector and responded to earlier concerns about regulation.
The Cayman Islands enacted the Confidential Relationships (Preservation) Law in 1976, making breaches of professional confidentiality a criminal offense except under the law’s procedures. This reinforced Cayman’s reputation for client privacy, while also creating tension with later transparency demands.
On August 15, 1984, the British Virgin Islands passed its International Business Companies (IBC) Act, allowing tax-exempt companies designed for non-resident business. The law became a major engine of BVI’s offshore sector and was widely imitated by other jurisdictions.
The United States and the United Kingdom (concerning the Cayman Islands) signed a treaty on July 3, 1986 to support mutual legal assistance in criminal matters. It signaled growing international demand for cooperation when offshore structures were suspected in crime or tax evasion cases.
The Bahamas introduced an International Business Companies framework (commonly associated with the late 1980s), giving non-residents a convenient corporate vehicle for cross-border activity. This broadened the region’s offshore offerings beyond traditional banking and trust services.
In 1989, the G7 created the Financial Action Task Force (FATF) to develop global measures against money laundering. Over time, FATF standards became central external pressure on Caribbean offshore centers to tighten “know your customer” checks and reporting systems.
Barbados’ International Business Companies Act (1991) established a licensing system for companies conducting “international business” from Barbados under special legislation. This policy supported Barbados’ shift toward services exports while tying offshore access to government licensing.
Caribbean governments and territories created the Caribbean Financial Action Task Force (CFATF) process beginning with meetings in Aruba (1990) and a ministerial declaration in Kingston, Jamaica (1992). CFATF helped spread shared anti-money-laundering expectations across Caribbean financial centers.
The Cayman Islands Monetary Authority (CIMA) was established under the Monetary Authority Law brought into force on January 1, 1997. CIMA merged key supervisory functions, helping Cayman manage growth in banks, funds, and other offshore services with a more centralized regulator.
The Bahamas Financial Services Board (BFSB) was inaugurated in April 1998 as a public-private body to promote and coordinate the financial services sector. As scrutiny increased, it also served as a key liaison between industry and government on reforms and reputation management.
In 1998, the OECD published Harmful Tax Competition: An Emerging Global Issue, arguing that certain low-tax and secrecy-based arrangements could undermine other countries’ tax bases. This report helped set the stage for later blacklists, peer reviews, and information-exchange demands that affected Caribbean offshore models.
The OECD’s Global Forum on Transparency and Exchange of Information for Tax Purposes was founded in 2000 and later restructured in 2009. Its peer reviews and standards for information exchange became a major driver pushing Caribbean offshore centers toward more transparency and cooperation.
On July 1, 2000, the U.S. Treasury’s FinCEN issued an advisory highlighting serious deficiencies in The Bahamas’ anti-money-laundering systems. The advisory illustrates how external regulators could influence Caribbean offshore centers through reputational and compliance pressure.
In December 2000, The Bahamas introduced the Financial Transactions Reporting Act, a core anti-money-laundering law supporting “know your customer” (KYC) requirements and reporting. This was part of a wider shift from secrecy-focused marketing toward compliance with international standards.
The BVI Business Companies Act (2004) came into force on January 1, 2005, replacing the earlier IBC Act. The new law modernized corporate rules while preserving the BVI’s role as a major jurisdiction for international company formation.
On March 18, 2010, the United States enacted the Foreign Account Tax Compliance Act (FATCA), requiring foreign financial institutions to report information on accounts linked to U.S. taxpayers. FATCA accelerated reporting infrastructure upgrades across Caribbean offshore centers that served international clients.
On July 15, 2014, the OECD Council approved the Common Reporting Standard (CRS) for automatic exchange of financial account information between tax authorities. CRS pushed many Caribbean jurisdictions to adopt standardized due diligence and annual reporting, reducing the competitiveness of secrecy alone.
On April 3, 2016, the Panama Papers stories were published, highlighting how offshore companies could be used to hide assets and avoid oversight (even though offshore entities can also be used legally). The leak intensified international focus on beneficial ownership—who really controls a company—directly affecting Caribbean offshore business models.
By the late 2010s and 2020s, the Caribbean’s main offshore centers increasingly emphasized regulated financial services—such as investment funds, insurance, trusts, and corporate services—under tighter transparency and anti-money-laundering expectations. The sector’s development shifted from simple secrecy and low taxes toward meeting global reporting, licensing, and supervision standards while still competing on efficiency and legal certainty.
