President Bill Clinton signed the Digital Millennium Copyright Act (DMCA), which implemented WIPO internet-era treaties and added major new rules for digital copyright. Jazz flutist and composer James W. Newton filed a federal lawsuit alleging that the Beastie Boys’ song “Pass the Mic” used part of his work “Choir” without a license to the underlying composition. The case highlighted a key sampling complication: sound recordings and musical compositions are separate copyrighted works. Even if a recording is licensed, the composition may still require permission.

By 2005, high-profile cases had produced different rules in different federal circuits: the Ninth Circuit accepted de minimis limits for composition claims in Newton, while the Sixth Circuit rejected de minimis copying for sound recordings in Bridgeport. This legal split encouraged cautious label policies, stronger sample-clearance departments, and creative workarounds (like replays and interpolations) to reduce lawsuit risk.
