In late 1887, major U.S. sugar refiners reached an agreement to combine operations under a trust arrangement commonly called the “Sugar Trust.” This set the stage for high market concentration in sugar refining and made sugar a major early test case for U.S. antitrust ideas.
New York’s highest court upheld the dissolution of the North River Sugar Refining Company for effectively surrendering its corporate independence to the trust. The decision showed that states could attack trust structures under corporate law, pushing large combinations to look for new legal forms.
Congress passed the Sherman Antitrust Act and President Benjamin Harrison signed it into law. The act aimed to curb monopolies and restraints of trade, creating a federal tool that reformers hoped would limit powerful “trusts,” including in sugar refining.

Henry O. Havemeyer testified to a U.S. Senate committee investigating the Sugar Trust and its role in tariff politics. The hearings highlighted how sugar refiners depended on trade policy (tariffs on raw and refined sugar) and raised public concerns about corporate influence on legislation.
The U.S. Supreme Court ruled that sugar refining was “manufacturing,” not interstate commerce, so the Sherman Act could not be used to break up the E.C. Knight/ASR control of refining. The decision sharply limited federal antitrust power against manufacturing monopolies during this period.
When Charles Dow created the Dow Jones Industrial Average, American Sugar Refining Company was included among the original 12 industrial stocks. Its presence signaled how central large sugar refiners had become to the U.S. industrial economy despite growing antitrust criticism.
A new large refiner, the National Sugar Refining Company of New Jersey, was formed by merging multiple New York-area refineries. It operated independently while ASR held a substantial stake, illustrating how “competition” could still be shaped by ownership ties and complex corporate arrangements.
In a dispute involving duties on Cuban sugar under a U.S.–Cuba trade agreement, the Supreme Court addressed when reduced tariff rates took effect for imports. The case underscored how sugar refiners’ profits could hinge on precise tariff timing and federal trade policy.
Henry O. Havemeyer, the key strategist behind the Sugar Trust and ASR’s early dominance, died in 1907. His death marked a leadership transition as Progressive Era pressure for stronger antitrust enforcement continued to grow.
The U.S. Department of Justice opened a federal antitrust case against American Sugar Refining Company as part of a broader Progressive Era push against concentrated corporate power. This action set up a long-running legal effort aimed at curbing ASR’s market conduct rather than relying on the weakened tools left by earlier court decisions.
A special congressional committee investigated the sugar industry, revisiting concerns about dominance, pricing power, and the political influence of large refiners. These investigations helped frame sugar as a continuing antitrust-era problem that blended industrial concentration with trade and tariff policy.
