After the Cuban Revolution, Cuba’s government moved to take control of major industries and land. In 1960, it nationalized many U.S.-owned businesses and properties, a major turning point in U.S.-Cuba relations. These expropriations (government takeovers) became a long-running dispute tied to later U.S. sanctions and legal claims.
President John F. Kennedy issued Proclamation 3447 declaring an embargo on trade with Cuba. The proclamation made a broad import ban effective at 12:01 a.m. Eastern time on February 7, 1962, and directed U.S. agencies to administer the restrictions. This created the core framework for the long-term U.S. embargo policy.
The U.S. Treasury Department issued the Cuban Assets Control Regulations (CACR), the main rules used to enforce U.S. embargo restrictions. These regulations restricted financial and commercial dealings involving Cuba and blocked certain Cuban assets in the United States. Over time, the CACR became the key legal mechanism for most U.S.-Cuba sanctions administration.
Congress enacted the Cuban Democracy Act (also called the Torricelli Act). Among other measures, it tightened restrictions related to trade involving foreign subsidiaries and set limits affecting vessels engaged in trade with Cuba. This law marked a major post–Cold War reinforcement of the embargo through statute rather than executive policy alone.
President Bill Clinton signed the Cuban Liberty and Democratic Solidarity (LIBERTAD) Act, known as the Helms–Burton Act. The law strengthened and effectively “locked in” the embargo by making key elements statutory, limiting how easily a president could end it. It also created new tools aimed at discouraging foreign investment linked to confiscated property.
The Organization of American States (OAS) voted to revoke its 1962 resolution that had excluded Cuba’s government from participating. The decision did not automatically restore Cuba’s participation; it set conditions and called for a dialogue process. This mattered because U.S. embargo policy had long been linked to hemispheric Cold War politics, which were shifting by 2009.
President Barack Obama announced a major policy shift to begin normalizing relations with Cuba. The approach sought to expand licensed travel and commerce while keeping the formal embargo law in place. This marked the start of a sustained regulatory effort to loosen parts of the sanctions under existing legal authorities.
The U.S. Treasury’s Office of Foreign Assets Control (OFAC) published updated CACR rules to implement the December 2014 policy changes. The amendments took effect January 16, 2015, expanding general licenses for certain categories of travel and authorizing additional financial and telecommunications-related activities. This showed how the embargo could be partially adjusted through regulations even without ending the underlying statutory embargo.
The U.S. State Department rescinded Cuba’s designation as a State Sponsor of Terrorism, effective May 29, 2015. This step was significant for diplomatic normalization and for certain export and financial restrictions that flow from the designation. However, it did not end the trade embargo itself, which continued under separate laws and regulations.
The United States and Cuba reopened embassies and restored formal diplomatic relations on July 20, 2015. This did not remove the embargo, but it created new channels for negotiation and practical coordination. It also helped enable continued regulatory changes around travel, banking, and authorized commerce.
President Donald Trump announced a rollback of parts of the Obama-era opening, including stricter enforcement of the ban on tourism and limits on certain transactions tied to Cuban state or military-linked entities. The announcement signaled a move back toward pressure-based sanctions policy. Many details depended on later agency regulations.
The U.S. ended its practice of routinely waiving (suspending) the right to sue under Helms–Burton Act Title III. As of May 2, 2019, eligible claimants could bring lawsuits in U.S. courts related to “trafficking” in certain confiscated property in Cuba. This expanded the embargo’s reach by increasing legal risk for some non-U.S. companies doing business involving contested assets.
The U.S. redesignated Cuba as a State Sponsor of Terrorism on January 11, 2021. The designation added significant financial and regulatory barriers and signaled a harder line in U.S. policy. It also increased “secondary” effects by making some third-country transactions more difficult when they touched U.S. rules or financial systems.
The Biden administration announced changes to increase support for the Cuban people, including steps related to family reunification and expanded flights. The shift aimed to adjust parts of sanctions and travel policy without ending the embargo framework. It illustrated how U.S. Cuba sanctions policy continued to change through executive action and regulation even while core embargo laws remained.
OFAC published amendments to the Cuban Assets Control Regulations in June 2022, implementing parts of the May 2022 policy changes. The amendments adjusted authorizations connected to travel and financial flows such as remittances, under U.S. licensing rules. This continued the pattern of using the CACR to fine-tune permitted and prohibited activities within the broader embargo.
Treasury announced and implemented CACR changes effective May 28, 2024, aimed at expanding authorizations for internet-based services and certain financial transactions. The stated goal was to support internet freedom and independent private sector entrepreneurs in Cuba. These amendments show how U.S. sanctions policy has increasingly included targeted permissions alongside long-standing restrictions.
The UN General Assembly voted overwhelmingly to condemn the U.S. embargo on Cuba for the 32nd consecutive year, highlighting sustained international opposition. The annual resolution is non-binding, but it reflects how the embargo remains a major global diplomatic issue. The vote also underscored that, despite periodic U.S. regulatory changes, the core embargo policy persisted into the mid-2020s.
On January 14, 2025, the U.S. notified Congress of the decision to remove Cuba from the State Sponsors of Terrorism list. The decision was linked in reporting to a deal involving the gradual release of prisoners by Cuba. The change mattered because the terrorism designation affects export controls, financial risk, and international banking relationships beyond the embargo rules alone.
By the mid-2020s, U.S. Cuba policy remained a mix of long-standing statutory embargo rules and frequently changing regulatory permissions and designations. Key parts of the embargo were codified in law (notably Helms–Burton), making full lifting dependent on Congress, while presidents continued to adjust travel, remittances, and listing decisions through executive authorities. The result is an ongoing, politically contested sanctions regime rather than a single “end” moment.
