The SEC disapproved the exchange rule change that would have allowed the Winklevoss Bitcoin Trust to list and trade. The decision focused heavily on concerns about fraud and manipulation risks in bitcoin markets and on whether the exchange could meet Exchange Act standards for protecting investors.
Later in March 2017, the SEC denied another attempt to list a bitcoin-tracking exchange-traded product—this one tied to the SolidX Bitcoin Trust on NYSE Arca. Together with the Winklevoss decision, it reinforced a clear early SEC pattern: spot-bitcoin products would be blocked without stronger market oversight and anti-manipulation protections.
In July 2018, the SEC issued another major disapproval involving the Winklevoss Bitcoin Trust. The repeat rejection signaled that, even after years of discussion, the SEC still found the spot-bitcoin market structure and surveillance environment insufficient for an exchange-listed product.
On August 22, 2018, the SEC rejected several proposed bitcoin ETFs, including products from ProShares, Direxion, and GraniteShares. These decisions emphasized recurring themes—especially market manipulation and whether a “regulated market of significant size” existed to support surveillance and enforcement.
In October 2019, the SEC rejected Bitwise’s proposal to list and trade a bitcoin ETF on NYSE Arca. The denial again centered on whether the exchange could demonstrate protections against fraudulent and manipulative acts—showing that detailed market-quality arguments still were not enough to satisfy the SEC.
In February 2020, the SEC rejected the Wilshire Phoenix proposal, another effort designed to address volatility and investor protection concerns. The decision continued the SEC’s long streak of spot-bitcoin denials and underscored how difficult it was to meet the agency’s anti-manipulation expectations for the underlying spot market.
On October 19, 2021, the ProShares Bitcoin Strategy ETF (BITO) began trading, providing regulated ETF access tied to CME bitcoin futures rather than holding bitcoin directly. This marked a key regulatory milestone: the SEC allowed bitcoin exposure via futures-based structures before it would allow spot-bitcoin holding products.
In January 2022, the SEC rejected Fidelity’s Wise Origin Bitcoin Trust proposal for a spot bitcoin ETF. The decision highlighted the SEC’s continued preference at the time for futures-linked products over spot holdings, keeping the main “spot ETF” path closed for large traditional issuers.
In April 2022, the SEC approved the Teucrium Bitcoin Futures Fund via an exchange rule filing under the Securities Act of 1933 structure. This mattered because many spot bitcoin ETF proposals also relied on similar exchange-rule approval pathways, and the Teucrium approval became an important reference point in later legal and regulatory arguments.
On June 29, 2022, the SEC denied Grayscale’s application to convert the Grayscale Bitcoin Trust (GBTC) into a spot bitcoin ETF, and Grayscale filed a petition for review the same day. The lawsuit turned the ETF fight into a court test of whether the SEC was applying consistent standards to futures-based and spot-based bitcoin products.
On June 15, 2023, BlackRock filed to launch the iShares Bitcoin Trust, a spot bitcoin ETF proposal that drew wide attention because of BlackRock’s size and track record in ETFs. The filing helped restart momentum across the industry, with other major firms updating or re-filing proposals using similar approaches to address SEC concerns.
On August 29, 2023, the U.S. Court of Appeals for the D.C. Circuit vacated the SEC’s order denying Grayscale’s proposed conversion, finding the agency’s reasoning inadequate under administrative law standards. This ruling increased pressure on the SEC to either better justify future denials or revisit how it evaluated spot bitcoin ETP proposals compared with futures products.
On January 9, 2024, the SEC said its official X (formerly Twitter) account was compromised after an unauthorized post falsely claimed spot bitcoin ETPs were approved. The incident briefly disrupted markets and underscored how closely investors were watching for the SEC’s decision.
On January 10, 2024, the SEC approved rule filings allowing multiple spot bitcoin exchange-traded products to list and trade on national securities exchanges—the first such approvals in the U.S. SEC Chair Gary Gensler emphasized the approval was tied to the specific filings and legal circumstances (including the Grayscale court decision) and did not represent an endorsement of bitcoin itself.
