William I’s government compiled Domesday Book to measure landholding and resources for taxation and lordship. Its manor-by-manor entries helped fix ideas about who held land, what it was worth, and what services or dues were owed. This set an early administrative backdrop for later, more detailed manorial law records.
A major legal treatise known as Glanvill was written in the late 1180s, describing writ-based procedures used in the king’s courts. Even though manorial courts were local, royal legal ideas influenced how people understood “law” versus “custom.” Over time, this helped create pressure to define and write down local customs more clearly.
From about 1200, written manorial court rolls survive in significant numbers, recording sessions of the court baron and (in some places) the court leet. These records documented land transfers, local by-laws, small disputes, and enforcement of labor and agricultural obligations. Writing created a durable “memory” for manorial law that could be consulted later.
Custumals developed as surveys listing a manor’s tenants and the rents, services, and other obligations owed under local custom. They provided a reference point for what “the custom of the manor” required, including payments in kind, labor services, and rules around inheritance and transfers. Because custom varied widely, custumals mattered most at the local level.
Henry de Bracton’s De legibus et consuetudinibus Angliae (written in the 13th century) became a key statement of English legal thinking about property and legal process. It highlighted how “custom” could function as a source of law, while also emphasizing royal courts and broader legal principles. This wider legal culture formed the background against which manorial customs were recorded and defended.
At Cuxham (Oxfordshire), surviving manorial court rolls begin in 1275 and continue through the later Middle Ages. Collections like this show how court records tracked landholding, inheritance, fines, and day-to-day governance over many generations. Such runs of records are central evidence for studying how manorial law operated in practice.
The statute Quia Emptores (1290) forbade creating new layers of lordship by subinfeudation when free land was sold. Instead, buyers would hold from the same chief lord and owe the same services. While many manorial tenants held by custom rather than free tenure, the statute shaped the wider land market and helped clarify how lordship and alienation worked.
The plague reached England in 1348 and caused extremely high mortality into 1349, creating major labor shortages. This shifted bargaining power toward surviving workers and tenants, putting pressure on customary labor services and manorial incomes. Manorial records from this period often show disputes and adjustments as lords and tenants reacted to the new conditions.
In 1351, Parliament passed the Statute of Labourers to control wages and labor mobility after the Black Death. The law aimed to stop workers from demanding higher pay and to push people back into service on pre-plague terms. This national policy became a major point of conflict underlying local enforcement and manorial tensions.
Between 1376 and 1381, England levied a series of poll taxes to fund war expenses. These taxes were widely unpopular, especially among poorer people, and enforcement could be harsh. The taxes added financial pressure to communities already in conflict over wages, labor rules, and manorial obligations.
In 1381, rebellion broke out in Essex and Kent and spread to London and other regions. Grievances included the poll tax and resentment against wage controls and attempts to enforce servile obligations. Although the revolt was suppressed, it marked a turning point: it showed the limits of coercion and helped accelerate longer-run changes in labor relations.
In 1388, Parliament passed the Statute of Cambridge, which restricted the movement of laborers and beggars unless they had official permission. It also made local areas responsible for supporting their own “impotent poor,” often described as an early step toward later poor-law systems. The statute reflected continued efforts to control labor in a world where manorial service obligations were weakening.
By the 15th century, “tenure by copy of court roll” (copyhold) became a common way for customary tenants to hold land, with their title evidenced by a copy of an entry made in the manor court’s records. This strengthened the practical importance of court rolls and custumals, because local custom defined inheritance rules, fines, and tenant rights. It also helped manorial law become more document-centered: proof increasingly depended on written records.
Manorial court rolls continued well past the medieval period, but the range of business gradually narrowed, with increasing focus on copyhold land transfers (surrenders and admissions). This long survival shows the lasting legacy of medieval manorial law and its documentation practices. By the end of the 15th century, the core system—local custom written into custumals and proven through court records—was firmly established.
