Congress passed the Sherman Antitrust Act to curb business combinations that restrained trade or tried to monopolize markets. The law gave the federal government (and private parties) a way to challenge anticompetitive conduct in interstate commerce. This created the legal foundation for later “trust-busting.”
The Supreme Court’s decision in United States v. E.C. Knight Co. limited federal antitrust power by drawing a sharp line between manufacturing and interstate commerce. Because sugar refining was treated as “manufacturing,” the government could not use the Sherman Act to break up the near-monopoly. The ruling made early Sherman Act enforcement harder against large industrial trusts.
In United States v. Trans-Missouri Freight Association, the Supreme Court held that the Sherman Act applied to agreements among railroads to set rates. The Court rejected the argument that “reasonable” rate-setting agreements should be allowed. This decision strengthened the idea that price-fixing among competitors could violate federal antitrust law.
In United States v. Joint Traffic Association, the Court again applied the Sherman Act to railroad associations that coordinated rates and competitive practices. The decision confirmed that industries already subject to regulation (like railroads) were not automatically exempt from antitrust rules. Together with Trans-Missouri, it signaled tougher scrutiny of coordination among competitors.
In Addyston Pipe & Steel Co. v. United States, the Court upheld action against a cartel that rigged bids and divided territories. The decision helped clarify that agreements whose main purpose is to restrain trade are unlawful, even if the firms claim their prices are “reasonable.” It became an important precedent for attacking straightforward collusion.
Financiers created the Northern Securities Company as a holding company to control major competing railroads in the Northwest. This structure aimed to reduce competition by putting rival lines under common control. Public controversy over the combination set the stage for a major federal antitrust test.
In 1902, the federal government filed suit to break up Northern Securities under the Sherman Act. The case became a defining early example of presidential support for using federal power against large corporate combinations. It also tested whether a holding company could be treated as an illegal restraint of trade.
Congress created the Department of Commerce and Labor and included a new Bureau of Corporations. The Bureau was designed to investigate corporate practices and publish reports, building a factual record about monopolies and market power. Its work supported later enforcement by gathering information the government could use in antitrust cases.
In Northern Securities Co. v. United States, the Supreme Court ruled 5–4 that the holding company violated the Sherman Act and must be dissolved. The decision showed the federal government could attack large consolidations that restrained interstate commerce, not just obvious price-fixing agreements. It became a turning point that encouraged more aggressive trust-busting.
In Swift & Co. v. United States, the Court upheld federal action against the “Beef Trust” by treating the business as part of an interstate “stream of commerce.” This approach avoided the strict manufacturing-versus-commerce limitation that had weakened enforcement in E.C. Knight. The decision made it easier to apply antitrust law to nationwide industrial systems.
The Hepburn Act expanded the Interstate Commerce Commission’s authority, including stronger oversight of railroad rates and related practices. While not an antitrust statute, it reflected the same Progressive Era push for federal control over powerful network industries. It also showed that regulation and antitrust enforcement often developed side by side.
In Standard Oil Co. of New Jersey v. United States, the Supreme Court held that Standard Oil had violated the Sherman Act and ordered it broken into separate companies. The Court also endorsed a “rule of reason” approach, focusing on whether a restraint of trade was unreasonable. The case became a central example of federal trust-busting against a dominant industrial firm.
In United States v. American Tobacco Co., the Court ruled that the company’s combination restrained trade and attempted to monopolize tobacco commerce, violating the Sherman Act. Like Standard Oil, the remedy involved dismantling a major corporate structure built through consolidation. These decisions signaled that the federal government could impose strong structural remedies, not just fines or injunctions.
The Federal Trade Commission Act established the Federal Trade Commission (FTC) to address “unfair methods of competition.” This added a specialized agency with investigative and administrative tools, complementing Sherman Act lawsuits brought in court. It marked a shift toward ongoing federal oversight, not only case-by-case prosecutions.
The Clayton Antitrust Act supplemented the Sherman Act by targeting specific practices associated with monopoly power and harmful consolidation. It aimed to stop certain conduct earlier—before it grew into full-scale market domination. Together with the FTC’s creation, it closed the 1890–1914 trust-busting period by building a more detailed and durable federal antitrust framework.
