Pope Alexander VI issued Inter caetera, backing the Spanish Crown’s claim to lands in the Atlantic world. This helped provide a legal-religious framework that Spanish officials later used to justify conquest, tribute, and coerced labor in the Americas.
Spain and Portugal signed the Treaty of Tordesillas, moving the line that divided their overseas expansion zones. The treaty strengthened Spain’s push to control and extract wealth from American territories, including through systems that compelled Indigenous labor.
Under Governor Nicolás de Ovando in Hispaniola, Spanish colonial administration relied heavily on compelling Indigenous labor and tribute to support settlement and extraction. These early Caribbean practices became a model for later, more formal labor regimes in Spanish America.
Royal policy legally defined the encomienda as a Crown grant that “entrusted” Indigenous communities to a Spaniard (the encomendero). In theory, the encomendero owed protection and Christian instruction; in practice, the grant often enabled harsh extraction of tribute and labor.
Dominican friar Antonio de Montesinos preached a sermon in Santo Domingo condemning Spanish colonists for the cruelty and injustice inflicted on Indigenous people under encomienda practices. The sermon became an early and influential challenge to coercive labor in Spanish America.
The Crown issued the Laws of Burgos (1512–1513) as early colonial legislation meant to regulate Indigenous work and living conditions in Spanish territories. While framed as protections, the laws also legalized and structured coerced labor tied to encomienda arrangements.
Spanish authorities introduced the Requerimiento, a text asserting Spanish rights of rule and demanding Indigenous submission. It helped provide a legal-theological justification for war and coercion when Indigenous communities resisted, shaping the environment in which forced labor systems expanded.
The Crown created the Viceroyalty of New Spain to strengthen royal authority over a rapidly growing colony. Stronger central government and courts supported more standardized management of Indigenous tribute and labor, including the allocation and oversight of encomiendas.
Charles V issued the New Laws to limit exploitation by encomenderos, including restricting inheritance of encomiendas and aiming to reduce Indigenous bondage. The reforms signaled a major policy shift: the Crown sought to pull control of Indigenous labor away from private colonists and toward royal administration.
Efforts to enforce the New Laws in Peru triggered violent resistance from powerful encomenderos. In the conflict, Viceroy Blasco Núñez Vela was killed in 1546, showing how difficult it was for the Crown to reform coercive labor when colonial elites depended on it for wealth and power.
After mid-century reforms, Spanish officials increasingly used repartimiento—a rotating draft of Indigenous workers assigned for set periods—to supply mines, farms, workshops, and public works. Compared with encomienda, repartimiento more directly involved the Crown in allocating labor, but it still produced serious abuses and coercion.
Spanish theologians and jurists debated whether conquest and coercion of Indigenous peoples could be morally and legally justified. Although it did not produce a single clear verdict, the debate highlighted growing official concern about violence and exploitation, and it reinforced pressure to curb the harshest forms of encomienda rule.
Bartolomé de las Casas published A Short Account of the Destruction of the Indies, describing severe abuses against Indigenous communities. The book strengthened reform arguments in Spain and became part of a wider struggle over how empire, conversion, and colonial labor should be organized.
By the start of the 1600s, repartimiento had, in many areas of New Spain, become the main formal system for drafting Indigenous labor, as encomienda’s labor monopoly weakened. Over time, this shift also helped open space for wage labor and expanding landed estates (haciendas), changing the structure of colonial extraction economies.
