The General Agreement on Trade in Services (GATS) took effect alongside the creation of the World Trade Organization (WTO). It created the first multilateral rulebook for international trade in services, such as finance, telecoms, and professional services. GATS also set an expectation of progressive liberalization through future negotiation rounds.
WTO members finalized the Fifth Protocol to GATS on financial services, updating and deepening commitments covering banking, insurance, and related activities. This was part of the “built-in” follow-on work left after the Uruguay Round, showing that services liberalization would continue through additional sector deals and later broader rounds.
The Fourth Protocol on Basic Telecommunications entered into force, bringing many countries’ telecom services commitments into their GATS schedules. A widely used “Reference Paper” on pro-competition regulatory principles helped link market opening with basic rules for how telecom markets would be regulated.
Members that had accepted the Fifth Protocol put it into effect, making expanded financial-services commitments operational for those participants. This marked a concrete step from negotiating text to real obligations in GATS schedules, reinforcing that services commitments could be updated after 1995.
A special session of the WTO Council for Trade in Services formally launched the next phase of services negotiations. This was the start of the first major effort to expand GATS commitments beyond the post-Uruguay Round sector protocols, using a broader request-and-offer process.
WTO members adopted the Guidelines and Procedures for the services negotiations. The guidelines clarified how talks would work and confirmed that negotiations would cover both market-access commitments and several “rules” topics (such as domestic regulation, safeguards, subsidies, and government procurement) within the GATS framework.
At the Doha Ministerial Conference, WTO members endorsed the ongoing services negotiations and set them inside the broader “single undertaking” of the Doha Development Agenda. This linked progress in services to progress across other areas (like agriculture and industrial goods), making overall outcomes harder to finalize but aiming for a balanced package.
Members began implementing the Doha services timetable by preparing requests (what opening they want from partners) and offers (what they are willing to commit). This approach made services talks highly detailed, because commitments are written sector-by-sector and often include limits on how foreign suppliers may operate.
After the 2003 Cancún Ministerial failed to deliver a full Doha package, the WTO’s July 2004 General Council decision helped restart work across the Doha agenda. For services, it reinforced that negotiations would continue within the overall Doha work program rather than being set aside.
At Hong Kong, members adopted a detailed services annex (Annex C) that pushed for higher-quality and broader commitments across the four GATS “modes of supply” (different ways services are delivered, such as cross-border supply or commercial presence). It also promoted plurilateral request approaches, where groups of members jointly seek commitments from others to accelerate progress.
As Doha talks intensified, the chair of the services negotiations circulated a report on “elements required for completion,” aiming to turn years of proposals into a workable landing zone. The report also anticipated a ministerial signalling step to show politically what improvements might be possible before final revised offers were submitted.
Trade ministers held a services signalling conference to indicate how they might improve offers, aiming to build confidence that services would contribute meaningfully to a final Doha package. The signalling step showed political engagement, but it did not by itself resolve core bargaining gaps across the broader Doha agenda.
At the Eighth WTO Ministerial Conference (Geneva), members adopted the LDC Services Waiver, allowing countries to grant preferential market access to services and service suppliers from least-developed countries even if it would normally violate the GATS most-favoured-nation rule. This decision shifted part of the services agenda toward development-focused flexibility after Doha-wide negotiations repeatedly stalled.
