The U.S.–Canada Free Trade Agreement (CUSFTA) took effect, setting a model for staged tariff elimination and deeper cross-border manufacturing links. For the auto sector, it reinforced already-strong U.S.–Canada production ties and helped normalize the idea of integrated supply chains across borders.
In 1990, Mexico’s automotive rules used trade-balancing formulas and local-content-style requirements that influenced where companies sourced parts and how much they imported. These policies were a major focus of NAFTA talks because they affected whether North American production could work as one connected system.
The United States, Canada, and Mexico signed NAFTA, committing to lower tariffs and create common trade rules across the region. This created the legal foundation for a continent-wide auto market where parts could cross borders multiple times during production.
The North American Agreement on Labor Cooperation (NAALC) was signed as a side agreement to NAFTA. While not an auto-specific rule, it addressed concerns that trade and investment could shift production to lower-wage locations without adequate labor protections.
The North American Agreement on Environmental Cooperation (NAAEC) entered into force alongside NAFTA and established institutions for cooperation and oversight. It reflected growing expectations that trade-driven industrial growth (including auto manufacturing) would be paired with environmental commitments.
NAFTA began, creating duty-free or reduced-tariff trade for goods that met its rules of origin—requirements that define when a product is “from” North America. For passenger vehicles and light trucks, a key test was regional value content (RVC), which under NAFTA was set at 62.5% for certain vehicles and core powertrain parts such as engines and transmissions.
At NAFTA’s start, Mexico lowered tariffs on cars and light trucks (from 20% to 10%), and the United States reduced or removed certain tariffs on Mexican vehicles and parts. These changes, combined with NAFTA eligibility rules, encouraged companies to build cross-border production plans to keep vehicles qualifying for preferential tariff treatment.
By 2008, NAFTA’s staged tariff elimination was largely complete for industrial trade among the three countries. With tariffs mostly gone for qualifying goods, rules of origin became even more important in practice—companies needed to prove North American content to secure duty-free treatment.
The United States Trade Representative notified Congress of the intent to begin NAFTA renegotiations. For the auto industry, the coming talks raised the possibility that rules of origin would tighten—potentially changing where parts were sourced and where assembly occurred to keep vehicles duty-free.
Leaders of the United States, Mexico, and Canada signed the USMCA, a new regional trade agreement intended to replace NAFTA. A central negotiation issue was autos: policymakers sought rules that would keep North American supply chains integrated while increasing regional sourcing and, in some areas, raising labor standards.
The three countries signed a protocol amending the original USMCA text, following additional negotiations in 2019. These updates helped clear the way for ratification and implementation, reducing uncertainty for industries planning multi-year sourcing and investment decisions.
USMCA took effect, replacing NAFTA and introducing stricter automotive rules of origin. Key changes included raising the passenger vehicle/light truck RVC requirement toward 75% (phased in), adding a Labor Value Content (LVC) rule tied to $16/hour wage benchmarks, and adding a North American steel and aluminum purchasing requirement.
USMCA’s automotive rules started on a transition schedule rather than switching instantly to the final thresholds. For passenger vehicles and light trucks, the regional value content requirement began at 66% (net cost method) and then stepped up annually, while the LVC requirement began at 30% and also increased during the phase-in period.
Mexico and Canada initiated dispute settlement over how to calculate regional content for vehicles and parts—especially whether certain “core parts” that qualify as originating can be fully counted as originating in the vehicle-level calculation (often discussed as “roll-up”). The case mattered because small calculation differences can change whether a vehicle qualifies for duty-free treatment.
A USMCA dispute panel ruled that the United States’ approach to certain automotive rules of origin calculations was inconsistent with the agreement. The ruling supported Mexico and Canada’s interpretation on treatment of originating core parts in regional value content calculations, influencing compliance strategies for integrated North American supply chains.
Under the USMCA schedule, the regional value content requirement for passenger vehicles and light trucks reached 75% (net cost method). This milestone marked the end of the main three-year RVC phase-in and signaled a higher bar for keeping vehicles and key parts within North American sourcing networks to preserve preferential tariff treatment.
By mid-2024, U.S. officials indicated they did not agree with the panel’s interpretation and that the three countries were still working toward a resolution. The ongoing disagreement showed how rules-of-origin design and enforcement can create uncertainty, even when supply chains are already deeply integrated across North America.
