The United States triggered the 90-day notice required under Trade Promotion Authority, signaling it would renegotiate NAFTA with Canada and Mexico. This step launched the process that would later produce USMCA, including new rules for digital trade and intellectual property.
The first negotiating round opened in Washington, D.C., beginning a series of talks to rewrite NAFTA for a more digital, services-oriented economy. Digital trade and IP became major themes because cross-border data flows, online services, and software were far more central than when NAFTA took effect in 1994.
A public draft of the agreement’s text was released, allowing stakeholders to examine specific digital trade and IP obligations. This made concrete what had been negotiated, including rules related to digital products and protections for intellectual property.
The United States, Mexico, and Canada signed the initial USMCA in Buenos Aires, setting the overall structure to replace NAFTA. The agreement included a dedicated digital trade chapter and a revised intellectual property chapter intended to update rules for online commerce, software, and copyrighted works.
Mexico’s Senate ratified the agreement, becoming the first of the three countries to approve it. Ratification helped keep the process moving, but debate continued in the United States about enforcement and some sensitive IP issues, especially around pharmaceutical-related protections.
All three countries signed a Protocol of Amendment that adjusted parts of the agreement to support ratification. One key change in the IP area was removing the requirement for at least 10 years of market exclusivity for biologic medicines, reflecting political compromise over drug-pricing concerns.
The U.S. House and Senate approved the implementing bill, a necessary step because trade agreements require changes to domestic law and enforcement tools. This set the stage for the United States to apply the agreement’s digital trade and IP rules through U.S. legal authorities.
The U.S. President signed the USMCA implementing legislation into law (Public Law 116-113). This made U.S. domestic legal changes effective for carrying out USMCA obligations, including rules supporting cross-border digital commerce and intellectual property protections.
Canada completed its domestic approval by granting Royal Assent to Bill C-4, the implementing legislation for CUSMA/USMCA. This step aligned Canada’s law with the updated agreement text (including the 2019 Protocol of Amendment) and cleared a final major hurdle to bringing the treaty into force.
The finalized, amended USMCA text made key digital trade commitments clear, including a ban on customs duties on digital products transmitted electronically. These provisions aimed to support cross-border e-commerce and reduce trade barriers created by taxing digital deliveries.
USMCA took effect, officially replacing NAFTA as the governing trade framework among the three countries. From this date, the agreement’s digital trade chapter and updated intellectual property chapter became operational commitments, shaping how the region handles data-driven trade and IP enforcement.
The USMCA Free Trade Commission (made up of the three governments’ trade ministers or their designees) held its first meeting. This created a formal venue to oversee implementation and address issues arising under the agreement, including cooperation and potential disputes affecting digital trade and IP obligations.
The three governments issued a joint statement marking one year since USMCA entered into force. This milestone highlighted the shift from negotiation and ratification to ongoing administration—where digital trade and intellectual property rules are tested through day-to-day trade and compliance questions.
