The United States, Mexico, and Canada signed the U.S.-Mexico-Canada Agreement (USMCA) as the replacement for NAFTA. The agreement’s updated labor commitments and enforcement tools were designed to make labor rights more enforceable in North American trade.
The United States enacted its USMCA implementing legislation, a key step needed before the agreement could take effect domestically. This law set up U.S. processes to carry out and enforce USMCA obligations, including labor enforcement structures.
USMCA entered into force, replacing NAFTA for trade among the three countries. This activated the agreement’s labor chapter and the facility-specific Rapid Response Labor Mechanism (RRM), which targets alleged labor-rights denials at individual worksites.
The U.S. Department of Labor announced it was prepared to enforce USMCA labor provisions and highlighted the interagency system for monitoring and enforcement. This process included receiving and reviewing Rapid Response petitions and moving quickly on credible allegations.
Worker and civil society organizations filed the first public Rapid Response petition, alleging labor-rights denials at Tridonex in Matamoros, Tamaulipas. The petition process became an important pathway for outside parties to trigger government review of specific facilities.
The United States requested that Mexico review alleged denials of freedom of association and collective bargaining at General Motors’ Silao facility in Guanajuato. This marked the first-ever use of the USMCA Rapid Response Labor Mechanism by any country.
After Mexico’s review, the two governments announced a course of remediation to address the denial of rights at the GM Silao facility. The plan focused on ensuring a new contract “legitimization” vote could occur under conditions intended to be free of intimidation and coercion.
USTR and Tridonex announced an agreement to address allegations that workers were denied free association and collective bargaining rights. The remediation included commitments related to backpay and severance for dismissed workers and neutrality in future union representation processes.
The United States sent Mexico a Rapid Response request for review regarding Teksid Hierro de México in Frontera, Coahuila. The action reflected the RRM’s facility-specific design: focusing enforcement on a particular worksite alleged to be denying labor rights under Mexican law.
The United States and Mexico announced the resolution of an RRM matter at the Panasonic Automotive Systems facility in Reynosa, Mexico. The announcement followed a U.S. request for Mexico to review the situation and reported improvements related to workers’ organizing and bargaining rights.
