In 1871, Congress ended the practice of making new treaties with Native nations. After this shift, major changes in tribal land and governance were increasingly imposed through federal statutes and administrative actions rather than negotiated treaties. This set the stage for nationwide land policies such as allotment.
President Grover Cleveland signed the Dawes (General Allotment) Act on February 8, 1887. The law authorized breaking reservation land into individual parcels (often 160 acres for heads of households) held in federal trust for a period (commonly 25 years) and treated remaining land as “surplus.” This approach aimed at assimilation but also enabled large-scale transfer of Native land to non-Native ownership.
In the late 1880s and 1890s, allotment was applied broadly to Plains reservations, changing land from tribal territory into a patchwork of individual allotments and non-Native holdings. Once allotments were made, land categorized as “surplus” could be sold or opened to homesteading, shrinking the reservation land base. This pattern reshaped local economies and limited tribes’ ability to manage land as a unified community.
The Curtis Act took effect on June 28, 1898, extending allotment policy into Indian Territory and weakening tribal courts and other governing structures there. While centered in what is now Oklahoma, it showed how Congress used allotment and related reforms to reduce tribal governmental authority while reorganizing land for non-Native settlement. It also reinforced the federal push toward individual landholding over tribal landownership.
In 1904, the federal government formally opened portions of the Rosebud Reservation in South Dakota to non-Native settlement through a registration and drawing process. This “opening” followed allotment and the designation of remaining land as available for entry under homestead laws. It illustrates how allotment policy on the Plains was tied directly to infrastructure for settlement—land offices, registration, and federal enforcement.
On May 8, 1906, the Burke Act amended the Dawes Act by allowing the Secretary of the Interior to issue early “fee patents” to allottees judged “competent.” Once land was converted from federal trust status to fee simple ownership, it became subject to state taxation and could be sold more easily. This change increased the risk of land loss for many Native families, including on Plains reservations where economic conditions were often harsh.
By the early 1900s, many reservations had been surveyed and allotted, and large areas were sold or opened as “surplus” lands. The result was a checkerboard pattern of ownership that made unified land use and tribal planning much harder. Over time, this process contributed to the steep decline in land held by Native people and tribes during the allotment era.
On June 2, 1924, the Indian Citizenship Act declared Native Americans born within U.S. territorial limits to be U.S. citizens. Citizenship did not end federal control over many aspects of reservation life, including trust land rules created under allotment policy. Still, it marked a major legal change in political status during the allotment period.
On February 21, 1928, the federal survey known as the Meriam Report ("The Problem of Indian Administration") was submitted and published. It reported severe poverty and major administrative failures affecting Native communities, criticizing conditions tied to earlier federal policies, including allotment. The report became a key evidence base for reformers arguing that the Dawes-era approach was not improving Native welfare.
After the Meriam Report, criticism of allotment increased and the pace of new allotments declined in the late 1920s and early 1930s. Policymakers increasingly treated allotment as a cause of land loss and economic instability rather than a solution. This shift helped build momentum for a major change in federal Indian policy.
On June 18, 1934, President Franklin D. Roosevelt signed the Indian Reorganization Act (IRA). The IRA ended the creation of new allotments and aimed to stop further erosion of the tribal land base, while encouraging stronger tribal self-government. For Plains tribes living with the long-term effects of the Dawes Act—reduced land, mixed ownership patterns, and weakened governance—the IRA marked a formal policy turn away from allotment.
By 1934, when allotment policy was halted, Native-held land had fallen dramatically—from about 138 million acres in 1887 to about 48 million acres. On the Plains, the resulting land pattern often left tribes with less land and less control over how land could be used, while non-Native ownership increased within reservation boundaries. This land loss and fragmented ownership became a lasting consequence that federal policy did not quickly reverse.
