President Abraham Lincoln signed the Homestead Act, creating a federal system to transfer surveyed public land to private settlers. The law offered up to 160 acres to eligible applicants who lived on and improved the land, helping drive new settlement across the Great Plains and other western areas.
The Homestead Act became active at the start of 1863, and people began filing claims at local federal land offices. Daniel Freeman filed one of the earliest claims in Nebraska on January 1, 1863, a story later used to symbolize the start of the homestead era.
Congress passed the Timber Culture Act to encourage settlers to plant trees on the mostly treeless Great Plains, where wood was scarce for buildings and fuel. The act allowed additional land claims tied to specific tree-planting and maintenance requirements, but it later became associated with fraud and uneven results.
Congress approved the Dawes (General Allotment) Act, dividing many reservation lands into individual allotments and treating Native people as individuals rather than as members of tribes. Lands declared “surplus” after allotment could be sold, and many areas were then opened to non-Native settlement, linking federal Indian policy to later homesteading expansion on the Plains.
A major land opening in central Oklahoma drew thousands of people who rushed to claim parcels under federal land rules tied to homesteading. The event showed how rapidly land could be transferred and towns could form when the federal government opened large tracts to settlement.
After years of criticism and evidence of manipulation by speculators, Congress repealed the Timber Culture Act. The repeal signaled growing federal concern that some land laws were being used to acquire property without meeting the intended settlement and improvement goals.
To address dry conditions and poor farming soils in parts of the Great Plains, Congress increased allowed claim sizes in specific areas. The Kinkaid Act let claimants in designated northwestern Nebraska counties seek up to 640 acres, reflecting the idea that larger tracts were needed to support a family in semi-arid regions.
As homesteading pushed into drier parts of the Great Plains, Congress broadened eligibility for larger farms suited to dryland agriculture (farming with limited rainfall). The Enlarged Homestead Act increased the maximum claim size in certain areas to 320 acres, aiming to make settlement more economically viable.
After decades of settlement, many of the remaining open lands were farther west and often more difficult to farm, but filings still surged in the early 1910s. The National Park Service notes that more claims were made in 1913 than any other year, showing how expansion continued even as the easiest land was already taken.
Congress created a separate homestead path aimed at livestock grazing on lands generally unsuitable for crop farming. The Stock-Raising Homestead Act offered up to 640 acres for ranching and introduced “split estate” rules in which the claimant received surface rights while the federal government often retained mineral rights beneath the land.
During the 1930s, federal policy shifted toward regulating and conserving overused public rangelands. The Taylor Grazing Act created grazing districts and a permit system, withdrawing large areas from the open public domain and making new homestead opportunities on many remaining Plains rangelands far more limited.
The federal government created a national monument on or near Daniel Freeman’s original claim in Nebraska to commemorate the Homestead Act and the wider homesteading experience. This marked a shift from promoting new settlement toward remembering and interpreting the long-term effects on land, communities, and Native peoples.
